Special-exposure time in old-age retirement calculations

Converted periods up to 13 November 2019 may increase contribution time, but they do not guarantee a higher INSS benefit.

Work involving harmful exposure may affect a Brazilian old-age retirement benefit when the special period is recognised and converted into ordinary contribution time. This does not guarantee an increase. Conversion is limited to work performed by 13 November 2019, does not replace contributions actually paid and does not, by itself, determine the qualifying period, coefficient or monthly amount. The rule used for the benefit and its calculation record must be checked.

The official sources consulted confirm conversion before that cutoff and state that the previdenciary factor may apply to old-age retirement when advantageous. They do not establish, on their own, that every converted period necessarily raises the factor or benefit. Any request must be assessed from the individual administrative record.

The 13 November 2019 cutoff

The first step is to separate periods by date. According to the INSS, conversion of special activity into ordinary time is allowed only for work performed up to 13 November 2019. Guidance from the Ministry of Social Security likewise says special time completed under the RGPS by that date may be converted, while later periods cannot be converted for benefit-award purposes.

This does not make later harmful work legally irrelevant. It may be considered under the rules for special retirement, but it cannot simply be multiplied and added as ordinary time. Classification follows the law in force when the work was performed.

What may change — and what does not change automatically

| Item checked | Possible effect of converted time |

|---|---|

| Contribution time | May increase after recognition of a pre-cutoff special period |

| Previdenciary factor | May require recalculation if the applicable rule actually uses converted time |

| Coefficient | Does not rise automatically; it depends on the award rule |

| Qualifying period | Conversion does not create months for which contributions were not paid |

| Period after 13/11/2019 | Cannot be converted into ordinary time |

| Meu INSS simulation | It is only a projection and does not definitively recognise entitlement |

The official urban old-age retirement page says the previdenciary factor may be used only when it is more advantageous. It does not say conversion automatically produces an increase. The relevant question is therefore not only “do I have special time?”, but “which formula was used, and does the recognised period enter that formula?”.

Factor, coefficient and qualifying period are different

The previdenciary factor is a possible component of certain formulas. The coefficient is the share of the contribution average used to form the benefit income. The qualifying period, or *carência*, is the minimum number of contributions required.

These concepts should not be treated as interchangeable. A converted period may expand the time considered in a calculation, but the additional notional time does not become a monthly contribution actually paid. For urban old-age retirement, the INSS lists requirements involving age, contribution time and qualifying contributions according to the insured person’s circumstances. For vested rights predating the reform, the general rule shown requires 180 monthly contributions, subject to a different table for certain people enrolled before 25 July 1991.

Documents to check before requesting an assessment

Begin with the PPP for each employment relationship involving exposure. The INSS says this document has been used to prove harmful exposure since 1 January 2004, replacing older forms. For employment beginning on or after 1 January 2023, proof is provided through the electronic PPP.

Then compare four sets of information:

1. PPP and older forms: agent, period, recorded intensity or concentration and technical professional.

2. CNIS record: employment dates and earnings. Support discrepancies with the work booklet, contribution booklets or equivalent documents.

3. Award letter and calculation record: chosen rule, credited time, average, coefficient and any previdenciary factor.

4. Administrative case: check whether the INSS expressly assessed every claimed special period and which evidence it accepted or rejected.

The INSS accepts documents concerning social-security relationships, including CTPS work booklets, CTC certificates, payment booklets and special-activity forms. A missing period in the calculation does not alone prove an error: evidence or formal recognition of exposure may be absent.

A simulation is not recognition

The “Simular Aposentadoria” service uses data in the INSS database and allows adjustments for projection purposes. The Institute warns that the result does not guarantee the simulated entitlement. Entries and changes at this stage apply only to the simulation; employment periods and evidence are checked when a claim is filed.

A higher projection after adding special time is therefore insufficient to establish that money is owed. For an existing benefit, compare the employment evidence with the administrative decision and calculation record. Only then can one determine whether a pre-cutoff period was overlooked, whether conversion is legally available and whether it changes the formula actually used. These rules concern Brazil’s RGPS/INSS system, not another country’s pension regime. Rules and services may change, so check the official links before filing a request.
